Can you press legal action after getting hit by a golf ball?

Here are the cirstances: A golfer isnt very good, and has been having a bad day. Also, this golfer was somewhat intoxicated by a couple beers. He judges the group in front of him to be far enough away, and tees up. He hits his best shot of the day and nails a dude in the back of the head. Can that dude press charges? Does the fact that golfing has an implied risk mean the tee-off person could get off the hook? (this is in california btw)
